This privacy policy contains information on the processing of personal data by the controller, mo-Vis BV, having its registered seat in  Biebuyckstraat 15D, 9850 Deinze (Belgium) and registered in the Crossroads Bank for Enterprises with the number 0540.663.251.

Mo-Vis BV is responsible for the processing of personal data in accordance with the Belgian Act of 30 July 2018 on the protection of natural persons regarding the processing of personal data and the European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data (“General Data Protection Regulation” / “GDPR”).

By using our website, subscribing to our newsletter, ordering products in the web shop, using our services or entering into a partnership with mo-Vis BV, you acknowledge being informed about the processing of your personal data.

Personal details we process and the purposes

Mo-Vis BV processes the following personal data in the course of its activities:

  • Customer/dealer data: when you enter into an agreement with us, we process various personal data including, among others: first name, last name, e-mail address, address, VAT number, payment details, telephone number, preferences and any other data you voluntarily submit to us. Customer and dealer data are processed in order to provide goods and services, comply with the agreement and to manage our accountancy, based on the performance of a contract and compliance with our legal accounting obligations. This way, we’re able to call you or send you an e-mail if this is necessary in order to carry out our services.  
  • Supplier data: in the event you provide goods or services to us, we process the following personal data including, among others: first name, last name, address, e-mail address, telephone number, VAT number, bank account number and any other data you voluntarily submit to us. Supplier data is processed to receive a quotation, to pay invoices, to communicate and to manage our accountancy, based on the performance of a contract and compliance with our legal accounting obligations.
  • Communication data: in the event you contact us by e-mail, telephone or by submitting a contact form on our website, we process the following personal data: first name, last name, e-mail address, telephone number and any other data you voluntarily submit to us in the course of the communication. These personal data are processed to answer your question and handle your request, based on the performance of a service you have requested for. It allows us to send you a newsletter and/or an advertising folder and to inform you about changes to our services and products.
  • Cookies: by visiting our website, we can collect your personal data, such as your IP address, through the use of cookies and similar technologies. These personal data are only processed with your explicit consent and are used to improve our website and to include personal data in anonymous statistics.

 

Special and/or sensitive personal data that we process

Our website and/or service does not intend to collect data on website visitors who are under 13 years of age. Unless they have permission from their parents or guardian. However, we cannot verify whether a visitor is over 13. We therefore recommend that parents be involved in their children's online activities, in order to prevent the collection of data about children without parental consent. If you are convinced that we have collected personal data on a minor without such consent, please contact us at contact@mo-vis.com and we will delete this information.

 

How long we keep personal details – retention period

Mo-Vis BV does not keep your personal data longer than strictly necessary to realize the goals for which your data is collected or to comply with legal regulations. We store customer and supplier data for up to 10 years after termination of the contract, given our legitimate interest to keep documentary evidence in the event of legal proceedings. In addition, due to legal accounting obligations, mo-Vis BV may retain accounting and tax documents for 10 years after the taxable period to which they relate.

 

Sharing personal information with third parties – recipients of personal data

Mo-Vis BV only provides personal information to third parties if this is necessary for the execution of our agreement with you or to comply with legal obligations. We may share your personal data with external service providers, accountancy firms and legal advisers. In addition, we may share your personal data in accordance with mandatory laws or regulations or based on a court order with public authorities, tax and customs authorities, financial investigation services and judicial and police services.

In the event these third parties are located outside the European Economic Area (“EEA”), we will ensure that your personal data is processed with the same level of security and protection as we apply within the EEA and we will take appropriate measures to protect your data during such transfers.

In the event of a change of control at mo-Vis BV or a (partial) transfer of our activities to another entity, your personal data will be transferred to guarantee the continuity of our services.

 

Reviewing, modifying or deleting data – data subject’s rights

You have the right to inspect, correct or remove your personal data. In addition, you have the right to information and access to your personal data, including a copy of the personal data undergoing processing. You have the right to withdraw your possible consent for the data processing or to object to the processing of your personal data by mo-Vis BV, in the event this is based on a legitimate reason and you have the right to data portability. This means that you can request us to send the personal data we have about you in a computer file to you or another organization named by you. In any event, you will have the right to object to the use of personal data for direct marketing purposes. You can send a request for inspection, restriction, correction, deletion (“right to be forgotten”), data transfer of your personal data or a request to withdraw your permission or to object to the processing of your personal data to contact@mo-vis.com. To make sure that the request for inspection was made by you, we ask you to send a copy of your identity document with the request. Make in this copy your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) black. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks. Finally, you also have the right to lodge a complaint with the Belgian data protection authority (“Gegevensbeschermingsautoriteit”) (“GBA”), Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be, if you consider that your rights regarding the processing of your personal data are not respected.

 

How we protect personal data

Mo-Vis BV takes the protection of your data seriously and takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized changes. Mo-Vis BV ensures that the data is stored in a secure environment, protected by a combination of appropriate organizational and technical measures, such as the use of a firewall, two factor authentication, the use of passwords and logins, etc. If you have the impression that your data is not properly secured or there are indications of abuse, please contact us via contact@mo-vis.com.
